  • Employers seeking to hire newcomers.

2. By using the platform, you confirm that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into these terms and comply with all applicable laws.

3. User Responsibilities

For Job Seekers:

  1. Ensure that all information provided during registration and job applications is accurate, current, and complete.
  2. Do not post false, misleading, or fraudulent information.
  3. Use the platform solely for lawful job-seeking purposes.
  4. Keep your login credentials confidential and secure.

For Employers:

  1. Ensure that job postings comply with all applicable labor laws and regulations.
  2. Provide truthful and accurate information in job advertisements.
  3. Treat all applicants with respect and fairness and adhere to Canadian anti-discrimination laws.
  4. Do not misuse the platform for any illegal or unauthorized purposes.

4. Acceptable Use

Users agree not to:

  1. Use the platform to distribute spam, malware, or other harmful content.
  2. Attempt to gain unauthorized access to the platform, its data, or its users’ accounts.
  3. Post or share any content that is unlawful, defamatory, obscene, or discriminatory.
  4. Use the platform for activities that violate Canadian employment laws.

5. Data Integrity and Non-Manipulation Policy

  1. NewcomerHire is committed to maintaining the integrity and accuracy of all data on the platform.
  2. The platform does not manipulate or falsify data for any reason.
  3. If any user contacts NewcomerHire requesting or attempting data manipulation, the platform reserves the right to:
    • Deny such requests.
    • Report the matter to the respective authorities or governing bodies.

6. Job Posting Policy

1. All job postings must:

  • Be genuine employment opportunities intended for newcomers to Canada.
  • Include accurate job descriptions, qualifications, and compensation details.

2. NewcomerHire reserves the right to remove job postings that:

  • Contain misleading, illegal, or inappropriate content.
  • Violate the platform’s terms or applicable laws.

7. Privacy and Data Use

  1. NewcomerHire collects and processes user data in accordance with its Privacy Policy. By using the platform, you consent to such data collection and use.
  2. User data will not be sold or shared with third parties, except as required by law or to facilitate the platform’s services.

8. Refund Policy

1. For Employers:

  • Refunds are only available if a technical error or platform failure prevents the job posting from being published.
  • Refund requests must be submitted in writing within 7 days of the issue by contacting customercare@newcomerhire.ca.
  • Refunds will not be provided if:
    • The job posting was published successfully.
    • The employer is dissatisfied with the number of applications received.
    • The employer violates any platform terms or applicable laws.
  • If a refund is approved, it will be processed within 14 business days.

2. For Job Seekers:

  • NewcomerHire is free for job seekers, and no charges apply.

3. Non-Refundable Fees:

  • Any fees paid for additional services (e.g., featured job postings, advertisements) are non-refundable unless a technical error occurs.

4. Platform Credit Option:

  • Instead of a refund, employers may choose to receive credit on their account to be used for future job postings.

9. Intellectual Property

  1. All content on the platform, including text, images, logos, and software, is the property of NewcomerHire or its licensors and is protected by copyright laws.
  2. Users may not copy, distribute, or use any content from the platform without prior written consent.

10. Disclaimers

  1. NewcomerHire does not guarantee:
    • Employment for job seekers.
    • The accuracy or authenticity of job postings.
  2. The platform acts as a medium connecting job seekers with employers and is not liable for disputes or issues arising between users.
  3. NewcomerHire is not responsible for any technical issues, interruptions, or errors on the platform.

11. Limitation of Liability

To the fullest extent permitted by law:

  1. NewcomerHire is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.
  2. Users agree to indemnify NewcomerHire from any claims, losses, or damages resulting from their use of the platform.

12. Termination of Services

  1. NewcomerHire reserves the right to suspend or terminate user accounts for:
    • Violations of these terms.
    • Engaging in fraudulent, illegal, or harmful activities.
  2. Users may terminate their account at any time by contacting customer support.

13. Modifications to Terms

  1. NewcomerHire reserves the right to update or modify these terms at any time without prior notice.
  2. Continued use of the platform after changes are made constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of Canada. Any disputes arising under these terms will be resolved in accordance with Canadian law.
